Request for Proposals (RFP): West Trail Culvert Temporary Repairs - Closed December 28, 2015

SEALED BIDS will be received by the San Mateo County Harbor District at the District Administration Office, until 12 PM December 28, 2015, at which time they will be publicly opened and read for performing work as follows:

Furnishing all labor, materials, equipment, and performing all work necessary and incidental to the construction of the project known as West Trail Culvert Temporary Repairs according to plans and specifications as prepared by San Mateo County Harbor District and according to the Contract Documents.

Project is to be completed within 31 consecutive calendar days from the date specified in the Notice to Proceed. Time for commencement and completion of the work is important, and is to be of the essence of the Contract.

A mandatory prebid conference will be held at 3 PM on December 22, 2015 at Pillar Point Harbor - Harbormaster's office.

Failure to attend will cause disqualification of a bidder.

Bidders may obtain copies of the bidding documents at the Harbor District Administration Office. A non-refundable charge of $20.00 in the form of cash or a check payable to San Mateo County Harbor District will be required for each set of documents.

Bids shall be executed upon the forms bound and made a part of said Manual. Bid guaranty in an amount not less than ten percent (10%) of the total bid dollar amount and conforming to the prescribed bidding procedures is required to be submitted with each bid, as a guaranty to be forfeited should the bidder, if awarded the contract, fail to enter into the same, or fails to furnish in a timely manner the bonds and/or proof of insurance.

Pursuant to the provisions of California Labor Code Section 6707, each bid submitted in response to this Invitation to Bid shall contain, as a bid item, adequate sheeting, shoring, and bracing, or equivalent method, for the protection of life and limb in trenches and open excavation, which shall conform to applicable safety orders. By listing this sum, the bidder warrants that its action does not convey tort liability to the Owner, the Design Consultant, the Owner's Representative, and their employees, agents, and sub consultants.

Pursuant to Section 1770, et. seq., of the California Labor Code, the successful bidder shall pay not less than the prevailing rate of per diem wages as determined by the Director of the California Department of Industrial Relations. Copies of such prevailing rate of per diem wages are on file with the Human Resources Department of the San Mateo County Harbor District, which copies will be made available to any interested party on request.

The successful bidder must insure that its policies and practices provide equal opportunity to all applicants and employees without regard to race, color, creed, sex, age, religion, ancestry, citizenship, national origin, handicap, mental condition, veteran or marital status. The successful bidder must comply with the Americans With Disabilities Act.

Pursuant to Public Contract Code Section 22300, for monies earned by the Contractor and withheld by the San Mateo County Harbor District to ensure the performance of the Contract, the Contractor, may, at its option, choose to substitute securities meeting the requirements of said Public Contract Code Section 22300.

All bidders shall be licensed under the provisions of Chapter 9, Division 3 of the Business and Professions Code of the State of California to do the type of work contemplated in the project. In accordance with provisions of California Public Contract Code Section 3300, the Owner has determined that the Contractor shall possess a valid Class A License at the time that the bid is submitted. Failure to possess the specified license shall render the bid as non-responsive.

The successful bidder will be required to furnish a Payment bond in the amount equal to one hundred percent (100%) of the Contract price, as well as a Faithful Performance Bond in the amount equal to one hundred percent (100%) of the Contract price.

Each bidder shall submit with its bid a statement setting forth its experience on the forms included in the Bid Proposal.

Bid forms received after the designated time will not be accepted.

No bidder may withdraw its bid for a period of sixty (60) days after the date set for the opening of bids.

The Owner reserves the right to reject any or all bids, and to waive any irregularities in the bids.

NOTICE INVITING BIDS: Oyster Point Marina/Park Asphalt Repair Projects 

NOTICE IS HEREBY GIVEN that sealed bids will be received in the Harbor District Administrative Offices, San Mateo County Harbor District (District), either by U.S. Postal Service addressed to its mailing address, PO Box 1449, El Granada, CA 94018, or by courier or personal delivery to 504 Avenue Alhambra, 2nd Floor, El Granada, CA 94018, on January 19th by 12:00 p.m., Pacific Standard Time, at which time bids will be publicly opened and read for the following:

CONTRACT NO. 04
Oyster Point Marina/Park Asphalt Repair Projects

The District seeks bids for Oyster Point Marina/Park Asphalt Repair Projects
Bids shall be submitted on the District's "Bid Form" and enclosed in a sealed envelope marked
"CONTRACT NO. 04 Oyster Point Marina/Park Asphalt Repair Projects"
and plainly endorsed with Bidder's name and address.

Bidders bidding as the prime contractor must possess a valid State of California TYPE/CLASS A CONTRACTOR Contractor's License at the time of contract award. All subcontractors, if any, must be properly licensed by the State of California to perform specialized trades.

A MANDATORY pre-bid conference will be held prior to the date of bid opening. District staff will be available to answer general questions pertaining to the solicitation documents and the specifications. Any questions that may require staff research to answer or that will otherwise modify the meaning or intent of this solicitation shall be submitted to the District in writing as described in Special Provision 1.8. The conference will take place on January 12th at 3:00 p.m. at 95 Harbormaster Road, South San Francisco starting at the Harbor Master Office. There will be a site visit immediately following the pre-bid conference. Any individuals who participate in the site visit must bring their own safety gear (hard hat, safety vest, safety glasses, and steel toed shoes) to wear during the site visit.

Bids must be accompanied by a deposit either in the form of a certified or cashier's check or Bidder's Bond, as described in the documents, which shall be applied to damages sustained by the District in the event that the successful Bidder fails or refuses to enter into a contract awarded to it by the District.

Requests for modifications or clarifications of any requirement must be submitted in writing to Emily Cooper by e-mail at ecooper@smharbor.com by January 13th at 4:30 p.m., Pacific Standard Time.

This is a Public Works Contract. The general prevailing rates of per diem wages and the general prevailing rates for regular (straight) time, holiday and overtime work in San Mateo County for each craft, classification and type of worker needed to execute the Contract shall be set forth in the current General Prevailing Wage Determinations made by the Director of Industrial Relations pursuant to California Labor Code Sections 1720 et seq. The current General Prevailing Wage Determinations are incorporated into the Contract, and are available at the California Department of Industrial Relations' website (www.dir.ca.gov/dlsr/DPreWageDetermination.htm). Should the general prevailing wage rates not specify a wage determination for a particular type of worker, attention is directed to 8 CCR 16202(b) regarding petitioning the Director of the California Department of Industrial Relations for a special wage determination. The District has made no request for such determination as the District does not know the specific type of workers intended by Contractor for this project. The District has not established a labor compliance program. Responsibility for labor law enforcement remains with the Division of Labor Standards Enforcement.

The successful Bidder will be required to furnish a Performance Bond and a Payment Bond, both in the amount set forth in the Special Provisions.

Pursuant to Public Contract Code Section 22300, the successful Bidder may submit certain securities in lieu of the District withholding funds from progress payments (retention) during the Project.

Bids will be examined and reported to the General Manager within ninety (90) calendar days after the bids have been opened. The District reserves the right to reject any and all bids, or to waive any irregularities or informalities in any bid or in the bid procedure, or to postpone the bid opening for good cause. No Bidder may withdraw its bid for a period of ninety (90) calendar days after the date of opening of the bids. Each Bidder will be notified of award of contract, if award is made.
